These Terms of Service ("Terms") govern your use of the Wake Rowing website and apps at wakerowing.com (the "Service"), operated by Wake Rowing ("we", "us"). By using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
The Service
Wake Rowing provides live regatta spectating and rowing-training tools, including a spectator viewer, an on-water capture app that records GPS tracks, and training reports and comparisons. The Service is offered on an "as available" basis and may change as we develop it.
Your account
Some features let you create a rower identity or sign in with Google or Apple. You are responsible for the activity on your account and for keeping your sign-in method secure. Provide accurate information and let us know promptly of any unauthorized use.
Acceptable use
You agree not to:
- Use the Service in any unlawful way or to infringe others' rights;
- Attempt to access data, accounts, or systems you are not authorized to access;
- Interfere with, overload, or disrupt the Service, including its tracking or ingest endpoints;
- Upload false, abusive, or misleading content, including impersonating another crew or rower;
- Reverse engineer or misuse the Service except as permitted by law.
Safety and reliance on tracking
The Service is for spectating and training, not for navigation, safety, or official race timing. GPS positions are approximate and may be delayed, inaccurate, or unavailable. Always follow the instructions of regatta officials and exercise your own judgment for on-water safety. Do not rely on the Service for any safety-critical purpose. Official results are determined by the regatta, not by Wake Rowing.
Your content
You retain ownership of the training data and tracks you record. You grant us the rights needed to host, process, and display that data to operate the Service for you (for example, showing your live position to spectators in a race you enter, or generating your training reports).
Intellectual property
The Service, including its software, design, and the "Wake Rowing" and "WAKE" names and marks, is owned by us and protected by applicable laws. These Terms do not grant you any right to use our brand without permission.
Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that positions and metrics will be accurate.
Limitation of liability
To the fullest extent permitted by law, Wake Rowing will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your use of or inability to use the Service. Nothing in these Terms limits liability that cannot be limited under applicable law.
Termination
You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms or to protect the Service and its users.
Changes to these Terms
We may update these Terms as the Service evolves. When we do, we will revise the "Last updated" date above. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
Governing law
These Terms are governed by the laws of the State of Ohio, United States, without regard to its conflict-of-laws rules, except where applicable law requires otherwise.
